> A sales agent is a company that sells a film's distribution rights to buyers around the world on behalf of the producer. It prepares sales estimates, takes the film to markets and festivals, negotiates license deals and minimum guarantees, collects delivery materials, and is paid a commission on sales plus recoupment of agreed marketing expenses.

## What the agent does across the film's life

In development and financing, the agent reads the script, weighs cast options, and produces estimates: a spreadsheet of territories with ask and take prices. Those estimates are what [gap lenders](https://storiara.com/glossary/gap-financing) and banks lend against and what investors look at in the business plan.

At film markets, including the American Film Market, the European Film Market in Berlin, and the Marché du Film at Cannes, the agent books meetings with buyers, screens footage or the finished film, and negotiates [pre-sales](https://storiara.com/glossary/pre-sales) and later sales. After a sale, the agent issues the contract, chases deposits, and manages delivery to each buyer.

## The sales agency agreement in numbers

Commission and expenses are the two lines producers negotiate hardest. The figures below are assumptions for an example, and deals vary.

If the agent licenses the unsold territories for $1,000,000, the commission is $150,000 and expenses (at the cap) are $75,000, so $775,000 flows on to the lenders and investors. If expenses weren't capped and the agent charged $140,000 for markets, screenings, and trailers, the producer's side would get $710,000 instead.

## Common problems with agents

Signing an agent with no track record in your genre wastes years. Ask for a list of recent sales, with territories and buyers, for films similar in budget and cast. Talk to producers who worked with them.

Unclear delivery lists are another source of trouble. The agent's delivery schedule sets what you must hand over, often including a [DCP](https://storiara.com/glossary/dcp), [M&E tracks](https://storiara.com/glossary/m-and-e-tracks), trailers, stills, chain of title documents, and E&O insurance. If you can't deliver, the agent can't collect the [minimum guarantees](https://storiara.com/glossary/minimum-guarantee), and some agency agreements let the agent charge the cost of creating missing items against your receipts.

Agreements should also require all money to go to the [collection account](https://storiara.com/glossary/collection-account), and give the producer approval over sales below the take price. For films without pre-sales, the agent is also a big part of [festival strategy](https://storiara.com/glossary/festival-strategy), since a premiere is when buyers pay attention.

## Frequently asked questions

### Is a sales agent the same as a distributor?

No. A distributor releases the film in its territory, pays for marketing there, and deals with cinemas, platforms, or broadcasters. A sales agent licenses the film to those distributors, territory by territory, and usually doesn't release it anywhere itself.

### When should I attach a sales agent?

For pre-sales and gap financing, before production, since lenders and buyers want to see the agent's estimates. For a film financed with equity and soft money, many producers approach agents with a cut, or after a festival acceptance.

### How are sales agents paid?

Through a commission on the money they bring in and recoupment of marketing expenses, both set in the sales agency agreement. Negotiate a hard cap on expenses and ask for an itemized list of what counts.

### Do I need a sales agent for a US-only release?

Not necessarily. A producer's rep or attorney often handles domestic sales to US distributors and streamers. International sales across many territories are where a sales agent's buyer relationships matter.
