# Oklahoma Film Incentives

> Oklahoma's Filmed in Oklahoma Act of 2021 is a cash rebate of 20% of qualified Oklahoma expenditures, rising to as much as 30% with uplifts for rural locations, small towns, certified soundstages, TV seasons, multi-film deals, post, and music. Projects need $50,000 in total expenditures and at least one day of principal photography in the state. The program is capped at $30 million per fiscal year and sunsets June 30, 2031.

## A rebate scored, not guaranteed

The Filmed in Oklahoma Act of 2021 replaced the older Compete with Canada Act's $8 million cap with $30 million a year. It pays a [cash rebate](https://storiara.com/glossary/cash-rebate), so there's nothing to sell. The Oklahoma Film + Music Office (OF+MO) pays the rebate after the final application and CPA review, and it must be paid out within two years of the start of principal photography.

Approval is competitive. A Department of Commerce Rebate Review Committee scores applications on economic impact, shoot days in Oklahoma, distribution, the creative team's track record, and the chance of follow-on work. Busy award periods need higher scores. OF+MO sets your rebate percentage at conditional prequalification, and it can drop an uplift you don't deliver. If your final claim comes in 15% or more below the prequalified amount, 1% of the rebate can be withheld.

The rebate range OF+MO publishes is 20% to 30%, so stacking more than 10 points of uplifts doesn't go past 30%.

## Worked example: $1,000,000 feature in eastern Oklahoma

A horror film spends $800,000 in Oklahoma: $700,000 on resident crew, Oklahoma vendors, and a farmhouse location in a small town in a county under 250,000 people, plus $100,000 for three nonresident department heads.

- Resident labor and vendors at 25% (20% base, 3% rural county, 2% small municipality): $700,000 x 25% = $175,000
- Nonresident BTL at 20%, no uplifts: $100,000 x 20% = $20,000
- Rebate: $195,000
- OF+MO administrative fee, 0.1% of the rebate: $195

The budget is under $7.5 million, so it competes for the $7.5 million small-project pool in one of six series and must hire two Oklahoma apprentices under a department head. The 25% location tests are measured in filming days, so the [shooting schedule](https://storiara.com/glossary/shooting-schedule) has to prove them.

## Worked example: $5,000,000 feature on a stage

The same producer spends $3,800,000 in Oklahoma, with 30% of principal photography at a certified stage and 4% of direct spend there, plus Oklahoma post at 3.5% of qualified spend. Rates: 20% + 5% stage + 3% post = 28%. At $3,800,000 x 28% = $1,064,000 before apprentice and ATL checks. Nonresident above-the-line pay can't exceed 25% of total expenditures (excluding BTL labor and Oklahoma ATL). This budget still falls under $7.5 million, so it draws from the smaller pool.

HB 2374 (2025) requires withholding Oklahoma income tax at the highest rate on payments to loan-out companies for work in Oklahoma. Out-of-state loan-outs also have to register with the Oklahoma Secretary of State to qualify.
